DKS TERMS OF SERVICE

Welcome to DKS. By accessing our website, purchasing our products, or subscribing to our SMS and email marketing, you agree to the following Terms of Service. Please read them carefully.


1. SMS & EMAIL COMMUNICATIONS

By providing your phone number and/or email at checkout or through opt-in forms, you agree to receive recurring marketing messages from DKS. These may include order updates, abandoned cart reminders, product releases, exclusive offers, and other promotional messages. Message frequency varies. Consent is not a condition of purchase.

Messaging Platform: Messages are sent via our third-party messaging platform under the sender ID “DKS” or other identifiers clearly associated with our brand.

Abandoned Checkout: If you begin the checkout process and do not complete it, we may send you reminders via SMS or email.

Opt-Out Instructions: You may unsubscribe at any time:

  • SMS: Reply STOP, END, CANCEL, UNSUBSCRIBE, or QUIT to any DKS message. You may also use the unsubscribe link (if available).

  • Email: Click the “Unsubscribe” link at the bottom of any DKS email.

Fees: DKS does not charge for SMS messages, but message and data rates may apply based on your mobile carrier’s plan.

Number Changes & Delivery Failures: We may modify the phone number or short code used to deliver messages. Messages sent to outdated numbers may not be received. DKS is not responsible for message delivery failures.

Privacy: Your data is never sold or shared. View our Privacy Policy for more information on how your information is collected and used.

By consenting to DKS’s SMS marketing in the checkout and initializing a purchase or subscribing via our subscription tools, you agree to receive recurring text notifications (for your order, including abandoned checkout reminders), text marketing offers, and transactional texts, including requests for reviews from us, even if your mobile number is registered on any state or federal do-not-call list. Message frequency varies. Consent is not a condition of purchase. If you wish to unsubscribe from receiving text marketing messages and notifications, reply with STOP to any mobile message sent from us or use the unsubscribe link we provided you within our messages. You understand and agree that the primary method for opting out of our SMS program is to reply with specific keywords (such as ‘STOP,’ ‘END,’ ‘UNSUBSCRIBE,’ ‘CANCEL,’ or ‘QUIT’), or to use the unsubscribe link provided. We will also honor any other requests that clearly express your desire to opt out, including phrases like ‘please opt me out.’ We do not charge for the service, but you are responsible for all charges and fees associated with text messaging imposed by your wireless provider. To the extent permitted by applicable law, you agree that we will not be liable for failed, delayed, or misdirected delivery of any information sent through the service, any errors in such information, and/or any action you may or may not take in reliance on the information or Service. 2. ARBITRATION AGREEMENT AND CLASS ACTION WAIVER

To ensure efficient resolution of any disputes, you and DKS agree to resolve disputes through binding individual arbitration, rather than in court.

a. Arbitration Agreement

Any controversy, claim, or dispute arising from or relating to:

  • These Terms,

  • Your purchase or use of DKS products/services,

  • Or any communication from DKS,

shall be resolved exclusively through final and binding arbitration under the rules of the American Arbitration Association (AAA), governed by the Federal Arbitration Act.

  • Location: Montgomery County, Maryland. You may choose to appear by phone, video call, or written submission.

  • Costs: Each party is responsible for their own legal fees and costs.

b. Exclusions

You may opt out of arbitration by mailing a written request within 30 days of your first purchase to:

Your letter must include your full name, mailing address, and a clear statement that you are opting out of the arbitration agreement.

c. Class Action Waiver

You agree to resolve disputes with DKS only as an individual, not as a class member or representative in any class, consolidated, or representative action.

Only a court—not an arbitrator—may decide issues regarding the enforceability of this waiver.


3. GENERAL TERMS

  • Modifications: We may update these Terms periodically. Your continued use of the website or services after such updates constitutes acceptance.

  • Governing Law: These Terms are governed by the laws of the State of Maryland, without regard to conflicts of law principles.
